1. Agreement
By creating an account or using Sendzoy (the Platform), a product by Ahanya IT Solutions, you agree to these Terms of Service, the Privacy Policy, the Acceptable Use Policy, the Refund and Cancellation Policy, and the Data Safety disclosures published on this website.
2. The service
The Platform provides multi-tenant software for WhatsApp Business operations, including workspace management, WhatsApp account connection via Meta Embedded Signup (when enabled), template tools, campaigns, contacts, Live Chat, chat history, agents, canned replies, business hours / off-hours replies, opt-out handling, messaging balance ledgers, and plan-based feature limits.
We do not guarantee Meta approval of any WhatsApp Business account, business verification, template approval, phone quality rating, message delivery, or uninterrupted access to Meta APIs.
3. Accounts and workspaces
You must provide accurate registration information and keep credentials secure. You are responsible for activity under your users and agents. Multi-workspace support may be available according to your plan; each workspace remains organizationally isolated in product access controls.
4. Fees: platform plans vs messaging balance
Platform subscription / plan fees cover access to the SaaS product, seats/limits, and plan feature flags. Messaging balance (prepaid usage credits) is separate and is consumed for eligible outbound WhatsApp sends according to platform selling rates and ledger rules.
Meta may also apply its own WhatsApp conversation or related charges under Meta’s billing relationship with you or your BSP arrangements; those charges are outside this Platform’s SaaS fee schedule unless expressly stated otherwise in your commercial agreement.
Where payment gateways are not connected, platform administrators may record offline payments and activate subscriptions manually. That operational method does not create additional payment-processor warranties.
5. Customer messaging responsibilities
You must only message recipients you are legally allowed to contact, maintain required opt-in/consent records, honor opt-outs (including STOP and similar keywords processed by the Platform), and follow Meta WhatsApp messaging policies and Indian applicable law (including relevant telecom and IT rules).
6. Acceptable use and suspension
We may suspend or restrict access for unpaid balances, abuse, security risk, policy violations, or Meta-side account issues. See the Acceptable Use Policy for examples of prohibited conduct.
7. Availability
We aim to keep the Platform available but do not provide a contractual uptime SLA or 24/7 support commitment on this website unless separately agreed in writing. Maintenance windows and dependency outages (including Meta) may occur.
8. Liability
To the extent permitted by applicable Indian law, the Platform is provided on an “as available” basis, and we are not liable for Meta policy actions, undelivered messages, lost profits, or indirect damages arising from WhatsApp networking or customer misuse.
9. Governing approach
These terms are intended for an India-operated commercial SaaS offering. Dispute resolution details may be confirmed in a separate commercial agreement when the operator’s legal identity and jurisdiction are configured for your deployment.
